Terms of Service

These Terms of Service ("Terms") govern access to and use of the eBuy.store website, applications, services, and marketplace (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility

• You must be at least 18 years of age to register, sell, or purchase items on eBuy.store.
• Users under 18 may browse the Platform only under parental or legal guardian supervision.
• You represent that you are legally capable of entering into binding agreements under Indian law.

2. Account Registration and Responsibility

• You are responsible for maintaining the confidentiality of your login credentials.
• You are solely responsible for all activity conducted through your account.
• You must notify eBuy.store immediately of any unauthorised access or suspected security breach.
• eBuy.store is not liable for losses arising from unauthorised account use.

3. Marketplace Role

Items on eBuy.store are sold either by independent sellers or by eBuy.store itself. Every listing shows who the seller is.

• Items sold by independent sellers. eBuy.store acts as an online marketplace intermediary. The seller owns the item, provides the listing, descriptions, images and representations, and is the party selling to the buyer. eBuy.store does not own, possess, store or inspect these items.
• Items sold by eBuy.store. Listings under the eBuy.store seller account are items from eBuy.store's own inventory. For these listings eBuy.store is the seller, and has the responsibilities of a seller under these Terms and applicable law.
• eBuy.store is not an auctioneer, agent, broker, certifier, or guarantor of items sold by independent sellers.
• Payments. Buyers pay eBuy.store through its payment gateway partner. eBuy.store holds the payment and releases the seller's share after delivery and the payout hold period, as described in the Payments & Payouts policy.

Sales by independent sellers are between the buyer and that seller, subject to Platform rules and admin oversight.

4. Expert Reviews and Opinions

• Experts engaged on the Platform provide independent opinions based on available information.
• Expert reviews do not constitute certifications, guarantees, valuations, or legal assurances.
• eBuy.store does not warrant the accuracy, completeness, or outcome of expert opinions.
• Sellers cannot override expert corrections once applied.

5. Listings and Seller Obligations

Sellers agree that:

• Only legally owned items or items with proper sale rights may be listed.
• Listings must be accurate, truthful, and not misleading.
• Replica, imitation, or reproduction items must be explicitly disclosed. Replicas of Indian currency notes may not be listed at all.
• Items must comply with the Prohibited & Restricted Items policy.
• Use of stolen, internet-sourced, or third-party images without rights is prohibited.

eBuy.store may remove, restrict, or suspend listings that violate Platform standards without prior notice.

6. Transactions and Payments

• Payments must be completed only through Platform-approved payment gateways.
• Off-platform transactions are strictly prohibited and not protected by eBuy.store.
• eBuy.store does not guarantee successful transactions, delivery timelines, or item condition.
• Buyers and sellers are responsible for complying with applicable tax, customs, and regulatory obligations.

7. Shipping and Delivery

• Items are delivered only to addresses in India.
• Coins, banknotes and other items at least 100 years old are antiquities under the Antiquities and Art Treasures Act, 1972, and may not be exported out of India without the permission of the Director General, Archaeological Survey of India.
• Sellers are responsible for packing, shipping, and dispatching items.
• Any shipment timelines shown are informational workflow indicators only and not guarantees.
• eBuy.store is not responsible for delays caused by sellers, logistics providers, customs, or external factors.

8. Refunds, Disputes, and Returns

• Buyers get a full refund when an item does not arrive, is materially not as described and returned, or arrives damaged or as an undisclosed replica and the claim is backed by an unboxing video, as set out in the Dispute, Returns & Refund Policy.
• Returns for change of mind are not accepted unless the listing says otherwise.
• Each claim is reviewed by a person against the evidence. Decisions are final within the Platform but do not limit your rights under consumer law.
• Abuse of dispute mechanisms may result in account enforcement.

9. Prohibited Conduct

You agree not to:

• Upload forged, stolen, illegal, or prohibited items, including anything listed in the Prohibited & Restricted Items policy.
• Manipulate listings, reviews, or disputes.
• Harass, threaten, defame, or abuse other users or staff.
• Attempt to bypass Platform safeguards or monitoring systems.

Violations may result in immediate enforcement action.

10. Intellectual Property

• Platform trademarks, logos, content structure, and branding are owned by eBuy.store.
• Users may not copy, reproduce, modify, or distribute Platform materials without permission.
• Sellers retain rights to their own content but grant eBuy.store a licence to display it for marketplace operations.

11. Suspension and Termination

• eBuy.store may suspend or terminate accounts at its sole discretion, with or without notice.
• Enforcement reasons are not required to be publicly disclosed.
• Termination does not waive outstanding obligations or liabilities.

12. Limitation of Liability

To the maximum extent permitted by law:

• eBuy.store is not liable for indirect, incidental, consequential, or punitive damages.
• Liability, if any, is limited to Platform service fees paid for the affected transaction.
• Users agree to indemnify eBuy.store against claims arising from their conduct, listings, or transactions.

13. Governing Law and Jurisdiction

• These Terms are governed by the laws of India.
• Courts located in Chennai, Tamil Nadu, shall have exclusive jurisdiction.

14. Grievances

Complaints about the Platform, a listing, an order or another user can be raised with the Grievance Officer under the Grievance Redressal policy, which sets out response timelines and appeal options.

15. Changes to Terms

• eBuy.store may update these Terms from time to time.
• Continued use of the Platform constitutes acceptance of revised Terms.
